Course Description
The seminar provides a framework and considerations for attacking and defending an appraisal in litigation.
Common mistakes made in appraising and testifying concerning an appraisal are stressed. Various standards and
ethical rules that are commonly misapplied or misunderstood are highlighted and explained. In addition,
common tricks and how to prepare for tricks on cross-examination are identified, as well as answering
hypothetical questions at trial. Part II also highlights substantive appraisal theory differences that often cause
different approaches and thus values for appraisals in litigation.

Course Objectives
1. Identify the various models of testifying and their appropriate applications.
2. Analyze commonly misapplied ethical requirements within USPAP and distinguish conflicts between USPAP ethics and attorney ethics.
3. Identify commonly misapplied USPAP standards and evaluate their proper application.
4. Evaluate Jurisdictional Exception considerations within USPAP and analyze situations in which they conflict with attorney ethics and legal considerations.
5. Identify common errors in the Cost Approach and evaluate methods for avoiding those errors.
6. Identify common errors in the Income Approach and evaluate methods for avoiding those errors.
7. Identify common errors in the Sales Comparison Approach and evaluate methods for avoiding those errors.
8. Differentiate legal questions from appraisal (fact) questions in litigation assignments.
9. Explain the respective roles of objective appraisers and adversarial attorneys throughout the litigation process.
10. Evaluate the legal and practical requirements for qualifying as an expert witness and determine when an assignment should be declined.
11. Identify rules of evidence applicable to attorneys and appraisers in litigation.
12. Differentiate between testifying witnesses and consulting witnesses and describe the responsibilities of each.
13. Apply checklists to the process of providing appraisal and consulting services.
14. Develop more effective appraisal reports and work file documentation that support litigation assignments.
15. Determine when an assignment constitutes an appraisal, appraisal review, or consulting service under USPAP.
