Course Description
This seminar equips appraisers with practical tools to navigate three critical areas of modern practice. The first part of the day, led by the State Demographer, explores key demographic trends-population shifts, aging, and employment patterns-and how they impact real estate markets and valuation assignments. After that, the topic shifts to focus on conservation easements, land use, and valuation challenges in Colorado's mountain and high-end residential markets. The afternoon wraps up with a risk management session covering appraiser negligence claims, case law, liability mitigation strategies, E&O insurance essentials, and best practices for report writing and workfile documentation.

Course Objectives
Explain the role of the State Demographer and key demographic trends influencing real estate demand, including population growth, migration patterns, household formation, and employment shifts.
Analyze the impact of an aging population on real estate market segments, including housing demand, income levels, and labor force participation.
Demonstrate how to access and apply demographic data from the State Demography Office to enhance market analysis, highest and best use determinations, and demand forecasting in appraisal reports.
Identify the unique valuation considerations associated with conservation easements on mountain residential properties, including their effect on marketability, use restrictions, and value.
Recognize the influence of the high-end Aspen market and the presence of ultra-wealthy buyers on regional property values, market dynamics, and highest and best use conclusions.
Discuss how land use regulations, view plane restrictions, building height limitations, and adverse easements affect property value and appraisal methodology in mountain resort communities.
Understand the legal elements of an appraiser negligence claim, including the concept of legal duty, standard of care, and the relevance of USPAP compliance in liability defense.
Evaluate the importance of clear intended use and user language in appraisal reports to mitigate liability exposure, referencing key case law such as Willemsen v. Mitrosilis.
Identify risk factors when working with high-risk clients, such as hard-money or alternative lenders, and develop strategies for risk avoidance and liability mitigation.
Outline best practices for minimizing liability, including proper workfile documentation, use of plain language disclosures, responding appropriately to subpoenas and claims, and understanding key provisions of E&O insurance policies.
